These Terms of Use govern your access to and use of the BlackBid platform ('Platform') operated by Fapps Ltd ('Company', 'we'). They are subject to English law and apply to all users of the Platform.
All natural persons ("User") accessing or becoming a member of the Platform are deemed to have read, understood, and accepted these Terms. If you do not accept the Terms, you must not use the Platform.

3.1. 3.1. The Platform is an e-commerce infrastructure where various products are offered for sale through an online auction method.
3.2. 3.2. Products published on the Platform have been purchased or procured from authorised sellers/distributors by BlackBid before the auction process begins. When the winning user purchases the relevant product through the Platform, a sales relationship is established between the User and the Seller Company.
3.3. 3.3. The services offered on the Platform generally include the following operations:
Creating membership and participating in auctions.
Real-time management of auction processes.
Granting a special purchase period to winners.
Payment, invoice, and delivery processes.
3.4. 3.4. The Platform reserves the right to update auction and sales conditions, introduce new features, or modify existing features in line with its operation and technical requirements.
4.1. 4.1. To become a member of the Platform, you must be 18 years of age or older and have legal capacity in accordance with applicable legislation.
4.2. 4.2. All information and documents you declare during membership must be accurate, current, and complete. The User is responsible for any liability arising from providing false or misleading information.
4.3. 4.3. The Company reserves the right to refuse, suspend, or terminate membership, including in the following cases:
4.4. 4.4. The User is responsible for all transactions made through their account. You must not share your account information and password with third parties, and you must immediately inform the Company in case of unauthorised use.
5.1. 5.1. For each product on the Platform, a start time, end time, and starting price are specified. Users can place bids manually within the specified rules during the auction period.
5.2. 5.2. At the end of the auction period, the User who places the highest bid is determined as the winning User with the right to purchase the relevant product. Winning an auction does not, by itself, mean the sale is complete.
5.3. 5.3. The winning User is granted the opportunity to purchase the product at their highest bid price by adding it to the cart within the period specified on the Platform. During this period:

Technical Fault and Cancellation: The Company reserves the right to unilaterally cancel, suspend, or postpone the auction process in exceptional circumstances (system errors, software faults, server/infrastructure problems, data inconsistencies, legal obligations, stock/supply issues, force majeure, etc.). An auction may be deemed invalid and cancelled by the Company in the following cases:
5.5. Refund and Redressal of Grievances: In the event an auction is cancelled due to a technical fault or obvious mistake, the Company:

Scope of Liability: In cases of cancellation due to technical fault or obvious mistake, the User cannot claim any compensation, loss of profit, moral damages, or additional benefit from the Company, other than the refunded payment and restored coupon rights. The Company's liability under this article is limited solely to the refund of the collected amount and the restoration of used rights.
5.7. 5.7. The times displayed on auction screens operate according to the system infrastructure. The Company is not responsible for delays caused by differences in the User's device time or internet connection.
To enhance platform reliability, the following critical metrics are instantly tracked and reported via system logs:
7.1. Legislation
Delivery and shipping processes are subject to the provisions of the Pre-Contract Information and Consumer Contract published on the Platform.
7.2. Duration
The user may exercise their right of withdrawal within 14 days from the date of receiving the product, except for the exceptions specified in the legislation, within the scope of distance sales.
7.3. Details
The right of withdrawal and refund processes are explained in the relevant agreements. The user cannot complete the order without approving these documents.
The User accepts and undertakes the following:
The User is obliged to comply with the following prohibitions to ensure that auctions conducted on the platform proceed fairly, transparently, and under real market conditions. Behaviours contrary to these prohibitions may result in the temporary or permanent closure of the account, non-refund of payments, and recourse to legal remedies, without any prior notice.
In case of violation of these obligations, the Company has the right to restrict, suspend, terminate the User's account, and resort to necessary legal remedies.
10.1. 10.1. The Company does not guarantee that the Platform will operate uninterruptedly or without errors. Temporary service interruptions may occur due to maintenance, updates, technical faults, or force majeure.
10.2. 10.2. The Company is not responsible for damages experienced by the User due to internet connection, device problems, unauthorised access, or security vulnerabilities arising from their own fault.
10.3. 10.3. Although the Company shows utmost care for the accuracy of the information and content provided through the Platform; certain technical errors or update delays may occur. Final records regarding product information, stock status, and pricing are based on the logs and database maintained in the Company's systems.
10.4. 10.4. Without prejudice to mandatory liability cases subject to applicable imperative provisions, the Company's total liability may be limited not to exceed the total amount paid by the User for the relevant transaction.
11.1. 11.1. Users' personal data is processed and protected in accordance with the UK GDPR and the Data Protection Act 2018, within the framework of the principles explained in the Privacy Policy and the Data Protection Notice.
11.2. 11.2. By using the Platform, the User accepts that they have read and understood these texts explaining the principles regarding the processing of their personal data.
13.1. 13.1. The Company reserves the right to unilaterally update and amend the Terms. When an update is made, the new version comes into effect as soon as it is published on the Platform.
13.2. 13.2. The User's continued use of the Platform after the amendment date signifies their acceptance of the updated Terms.
14.1. 14.1. These Terms are governed by the laws of England and Wales.
14.2. 14.2. In disputes arising from these Terms, the courts of England and Wales have jurisdiction. For Users with consumer status, rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 are reserved.
These Terms of Use remain in effect and become binding for the User upon their access to or membership of the Platform.
